Terms of Service

1. Acceptance of Terms

By accessing or using PulseOps services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

PulseOps provides uptime monitoring, incident management, and status page services. We monitor your specified endpoints and notify you of issues according to your configuration.

3. Account Registration

To use PulseOps, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Monitor endpoints without proper authorization
  • Abuse or overload our infrastructure
  • Interfere with other users' access to the service
  • Use the service to spam or harass others
  • Reverse engineer or attempt to extract source code

5. Subscription and Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Prices are subject to change with 30 days notice
  • You can cancel your subscription at any time
  • Refunds are provided on a case-by-case basis
  • Failed payments may result in service suspension
  • Enterprise plans require custom agreements

6. Service Level Agreement (SLA)

We strive to maintain 99.9% uptime for our service. If we fail to meet this commitment, you may be eligible for service credits as outlined in our SLA documentation (available to Professional and Enterprise customers).

7. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using PulseOps, you consent to our data practices as described in that policy.

8. Intellectual Property

PulseOps and its original content, features, and functionality are owned by PulseOps Inc. and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

PulseOps is provided "as is" without warranties of any kind. We are not liable for:

  • Service interruptions or downtime
  • Data loss or corruption
  • Indirect, incidental, or consequential damages
  • Missed alerts or monitoring failures
  • Actions taken based on our monitoring data

Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold PulseOps harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

11. Termination

We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service
  • Fail to pay subscription fees
  • Engage in fraudulent activity
  • Use the service in a way that harms others

Upon termination, your right to use the service will immediately cease.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the service. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes shall be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court.
